CMS Toolkit available on working with agents and brokers during the Medicare Open Enrollment period

Each year Medicare beneficiaries are bombarded with information during the Medicare Open Enrollment period (which runs from October 15 to December 7). For most beneficiaries this is the only time they can make changes to their Medicare Advantage (health plan) and/or prescription drug (Part D) coverage. Most have many choices and only this short timeframe to make comparisons and decisions. Unfortunately every year unscrupulous insurance agents and companies take advantage of beneficiary confusion during this Open Enrollment season. In an effort to stop this unwanted activity CMS has developed the below toolkit and information:

Medicare Open Enrollment is Oct. 15 – Dec. 7, 2012

As Medicare Advantage (MA) and Medicare Prescription Drug Plans (PDPs) market their 2013 products, CMS wants to make sure that the agents and brokers working on behalf of these plans are following Medicare’s laws and guidelines. CMS needs your help to make sure agents and brokers act appropriately.

CMS has created a set of education and outreach materials in the attached toolkit you can use to help in surveillance and enforcement efforts. Here’s what the toolkit includes:

  • “Agent in My Home” Fact Sheet: This consumer fact sheet explains how agents/brokers should conduct themselves when meeting with people with Medicare in their homes, and applies year-round (includes Spanish and Chinese versions).
  • SMART Referral Form: Use this form to report suspicious marketing activities.
